Legal departments play a pivotal role in the quality of contracts and contracting processes within an organization. This article reflects on current developments and innovations in contracting practice and their impact on the role of legal professionals and legal departments within organizations. Based on empirical research among legal professionals and legal departments in Dutch legal practice, the article positions contracts and contracting within the legal function of an organization and discusses developments in contract management, automated contract assembly and legal design and their potential impact on the role of legal professionals and legal departments. Finally, areas for future research are identified. Throughout the article, the focus is on large commercial organizations.

Zet in de juridische dienstverlening de mens centraal en begin bij de rechtsbehoeften van mensen. Daar pleiten lector Ineke van den Berg en interdisciplinair designer Peter van den Heuvel voor. Beiden zijn actief voor de onderzoekslijn Toegankelijkheid van het Recht. Afgelopen december publiceerden ze hun Basisboek legal design waarmee studenten en professionals leren hoe je met een designaanpak het recht toegankelijk maakt.

Legal design is een interdisciplinaire ontwerpaanpak om juridische problemen te voorkomen of op te lossen. Voorbeelden van ontwerpen zijn toegankelijke documenten, laagdrempelige dienstverlening, gebruiksvriendelijke apps en toegankelijke rechtspleging. Het sluit aan bij de rechtsbehoeften van mensen, en het doel is dat de toegang tot recht voor iedereen mogelijk wordt. Basisboek legal design beschrijft de kernconcepten die van belang zijn bij legal design, zoals inleven in de ander, met andere ogen kijken, ideeën opdoen en uitwerken. Het boek bespreekt verschillende manieren om legal design te benaderen. Ook bevat het tools en methoden waarmee studenten vaardigheden kunnen ontwikkelen om de beschikbare technieken te gebruiken. Het boek maakt de verbinding tussen theorie en praktijk door middel van kleine en omvangrijke juridische cases, vragen en opdrachten. Op de bijbehorende website komen extra opdrachten en design formats en er komt een docentenhandleiding beschikbaar. Dit boek is geschreven voor hbo-studenten van juridische opleidingen, zoals HBO-rechten en Sociaal Juridische Dienstverlening. Het is ook zeer geschikt voor juridische professionals die willen kennismaken met legal design en voor mensen die in de dagelijkse praktijk te maken hebben met juridische professionals, zoals designers, ict’ers, taalkundigen, psychologen en managers.
The impacts of tourism on destinations and the perceptions of local communities have been a major concern both for the industry and research in the past decades. However, tourism planning has been mainly focused on traditions that promote the increase of tourism without taking under consideration the wellbeing of both residents and visitors. To develop a more sustainable tourism model, the inclusion of local residents in tourism decision-making is vital. However, this is not always possible due to structural, economic and socio-cultural restrictions that residents face resulting to their disempowerment. This study aims to explore and interpret the formal processes around tourism decision-making and community empowerment in urban settings. The research proposes a comparative study of three urban destinations in Europe (The Hague in the Netherlands, San Sebastian in Spain and, Ioannina in Greece) that experience similar degree of tourism growth. The proposed study will use a design-based approach in order to understand tourism decision-making and what empowers or disempowers community participation within the destinations. Based on the findings of primary and secondary data, a community empowerment model will be applied in one the destinations as a pilot for resident engagement in tourism planning. The evaluation of the pilot will allow for an optimized model to be created with implications for tourism planning at a local level that can contribute to sustainable destinations that safeguard the interests of local residents and tourists.
During the coronavirus pandemic, the use of eHealth tools became increasingly demanded by patients and encouraged by the Dutch government. Yet, HBO health professionals demand clarity on what they can do, must do, and cannot do with the patients’ data when using digital healthcare provision and support. They often perceive the EU GDPR and its national application as obstacles to the use of eHealth due to strict health data processing requirements. They highlight the difficulty of keeping up with the changing rules and understanding how to apply them. Dutch initiatives to clarify the eHealth rules include the 2021 proposal of the wet Elektronische Gegevensuitwisseling in de Zorg and the establishment of eHealth information and communication platforms for healthcare practitioners. The research explores whether these initiatives serve the needs of HBO health professionals. The following questions will be explored: - Do the currently applicable rules and the proposed wet Elektronische Gegevensuitwisseling in de Zorg clarify what HBO health practitioners can do, must do, and cannot do with patients’ data? - Does the proposed wet Elektronische Gegevensuitwisseling in de Zorg provide better clarity on the stakeholders who may access patients’ data? Does it ensure appropriate safeguards against the unauthorized use of such data? - Does the proposed wet Elektronische Gegevensuitwisseling in de Zorg clarify the EU GDPR requirements for HBO health professionals? - Do the eHealth information and communication platforms set up for healthcare professionals provide the information that HBO professionals need on data protection and privacy requirements stemming from the EU GDPR and from national law? How could such platforms be better adjusted to the HBO professionals’ information and communication needs? Methodology: Practice-oriented legal research, semi-structured interviews and focus group discussions will be conducted. Results will be translated to solutions for HBO health professionals.
Intelligent technology in automotive has a disrupting impact on the way modern automobiles are being developed. New technology not only has brought complexity to already existing information in the car (digitization of driver instruments) but also brings new external information to the driver on how to optimize the driving style amongst others from the perspective of communicating with infrastructures (Vehicle to Infrastructure communication (V2I)). The amount of information that a driver has to process in modern vehicles is increasing rapidly due to the introduction of multiple displays and new external information sources. An information overload lies awaiting, yet current Human Machine Interface (HMI) designs and the corresponding legal frameworks lag behind. Currently, many initiatives (Pratijkproef Amsterdam, Concorda) are being developed with respect to V2I, amongst others with Rijkswaterstaat, North Holland and Brabant. In these initiatives, SME’s, like V-Tron, focus on the development of specific V2I hardware. Yet in the field of HMI’s these SME’s need universities (HAN University of Applied Science, Rhine Waal University of Applied Science) and industrial designers (Yellow Chess) to help them with design guidelines and concept HMI’s. We propose to develop first guidelines on possible new human-machine interfaces. Additionally, we will show the advantages of HMI’s that go further than current legal requirements. Therefore, this research will focus on design guidelines averting the information overload. We show two HMI’s that combine regular driver information with V2I information of a Green Light Optimized Speed Advise (GLOSA) use case. The HMI’s will be evaluated on a high level (focus groups and a small simulator study). The KIEM results in two publications. In a plenary meeting with experts, the guidelines and the limitations of current legal requirements will be discussed. The KIEM will lead to a new consortium to extend the research.
